Critical Analysis of the Ethical Use of Artificial Intelligence (AI) by Legal Practitioners in South Africa: Comparative Lessons from Germany and France

This study critically analyses the ethical use of Artificial Intelligence (AI) by legal practitioners in the South African courts. The study uses doctrinal research methodology to examine primary and secondary sources. It explores the intersection between emerging technologies and professional ethics, raising key questions about lawyers’ honesty, responsibility, and accountability in an era where algorithmic tools are increasingly used in litigation. An analysis of existing South African statutory frameworks reveals a regulatory gap. This study proposes the inclusion of AI-specific standards in professional regulations. The paper compares the application of AI in the South African courts with that in the European Union countries, specifically Germany and France. The study concludes that reform is urgently needed to preserve judicial integrity and uphold public confidence in the legal system.
