The EU AI Act and the Emerging Governance Generation Gap

The EU AI Act represents one of the first large-scale attempts to establish a unified governance framework for artificial intelligence across industries and societal systems. This paper examines the structural limitations emerging inside the Act after its formalization, focusing not on political positioning or regulatory preference, but on the growing mismatch between static governance structures and rapidly evolving AI systems. The analysis argues that the central challenge is no longer merely regulatory lag, but the emergence of a governance generation gap: a condition in which governance systems increasingly regulate previous generations of AI while newer capability structures evolve beyond existing legal assumptions and procedural frameworks. The paper further examines: • the instability of risk classification under evolving foundation models• the limits of static regulatory categories• procedural compliance and the illusion of safety• temporal desynchronization between institutional systems and AI evolution• the expansion of procedural governance under escalating complexity• the institutionalization of governance operating upon “historical residue” Rather than arguing against AI governance itself, the paper suggests that future governance structures may need to evolve beyond industrial-era static regulatory assumptions toward models capable of remaining dynamically synchronized with continuously evolving capability environments.
