Artificial intelligence governance has largely been built around a familiar assumption: the artificial system may become unsafe, while the human remains the legitimate source of purpose, correction, and control. This assumption becomes insufficient when advanced AI systems operate as components of situated human-AI formations capable of persistent reasoning, tool use, external action, and long-horizon goal pursuit. Harmful action may emerge not only when artificial intelligence deviates from human intention, but also when the human intention itself is unlawful, reckless, or adversarial. This paper introduces Hybrid Rule of Law: a legal and institutional framework for governing consequential actions that emerge through human-AI trajectories rather than from either the human or artificial component considered in isolation. Building on the concept of Observability of the Observer, the paper proposes the hybrid trajectory as the primary unit of legal reconstruction and argues that observability can acquire an evidentiary function: enabling the reconstruction of purpose, authorization, permissions, intervention, emergence, and consequence across human-AI action. The central thesis is that human oversight is not equivalent to legitimate oversight. When the human component itself supplies an unlawful or adversarial purpose, AI alignment alone cannot constitute a sufficient normative solution. A mature hybrid society will therefore require legislative definitions of unlawful hybrid conduct, hybrid forensic capacity, evidentiary standards for provenance of agency, independent judicial attribution of responsibility, and constitutional safeguards preventing necessary observability from becoming permanent cognitive surveillance. Hybrid Rule of Law therefore shifts the fundamental governance question from how to keep AI aligned with humans to how to keep human-AI power aligned with a legitimate social order.
