DEFIANCE Act of 2025

Amends the Consolidated Appropriations Act, 2022, to include provisions for civil action against the non-consensual use of intimate digital forgeries created using AI. Defines "intimate digital forgery" as digitally manipulated depictions of identifiable individuals that are indistinguishable from authentic images. Allows identifiable individuals depicted in unauthorized intimate digital forgeries to sue for damages in U.S. district courts. Permits recovery of either liquidated damages up to $250,000 or actual damages, including defendant's profits. Grants courts the authority to issue protective measures to ensure plaintiffs' privacy, including pseudonyms and sealed documents. Establishes a statute of limitations for civil actions of 10 years from the individual's awareness of the violation or reaching adulthood. Clarifies that the Act does not preempt or limit existing Federal, State, or Tribal law and allows additional protective laws.
