S 3742 AV Safety Data Act 2026

Enacts the "AV Safety Data Act" to enhance incident reporting for certain autonomous vehicles. Requires the Administrator of the National Highway Traffic Safety Administration (NHTSA) to establish regulations within 90 days mandating that manufacturers and operators of vehicles with Automated Driving Systems or Level 2 Advanced Driver Assistance Systems submit incident reports. Obligates covered entities to provide monthly reports on vehicle miles traveled, collision incidents causing injury to vulnerable road users or others, and details of unplanned stoppage events. Permits data reporting only if the Level 2 system was engaged or during specified conditions, without including drivers' personally identifiable information. Instructs the Administrator to make submitted reports publicly available online in a machine-readable format 120 days post-enactment. Allows the Administrator to rescind or adjust these regulations after ten years to modify the required reporting frequency and scope.
