Georgia SB 9 ("Ensuring Accountability for Illegal AI Activities Act")

Enacts measures to address the use of AI-generated media in elections. Defines "materially deceptive media" and prohibits its publication with intent to deceive voters within 90 days of an election, establishing offenses for fraudulent election interference and solicitation thereof. Excludes activities protected by the First Amendment, such as satire or journalism. Prescribes penalties, escalating from misdemeanors to felonies for repeat offenses, and grants jurisdiction to the Attorney General for prosecution upon recommendation from the State Election Board. Allows injunctive relief claims by affected individuals, candidates, or the Attorney General. Mandates disclosure in campaign ads using AI-generated content, detailing implicated parties, and warning of potential fictitious elements. Regulates disclosure visibility and audibility, imposing fines for violations. Empowers the election oversight commission to investigate complaints and promulgate rules under the act, effective upon gubernatorial approval or legislative enactment.
